EB-2 National Interest Waiver

The EB-2 National Interest Waiver (NIW) is an immigrant visa category for professionals whose work brings substantial value to the United States. It grants a direct path to a Green Card without requiring a job offer or employer sponsorship.

Key Advantages & Benefits

1

Self-petition — no employer, sponsor, or job offer required and no labor certification (PERM).

2

Direct path to a Green Card and permanent U.S. residency for you and your family.

3

Complete flexibility — change employers, start a business, or work independently.

4

Premium Processing available with a 45-day USCIS response window.

5

Suitable for a wide range of professions: STEM, healthcare, entrepreneurship, arts, education, and more.

Qualification Requirements

  • Advanced degree (Masters or higher), or a Bachelors degree plus 5 years of progressive experience, or exceptional ability proven through at least 3 of 7 regulatory criteria.

  • Your work has substantial merit and national importance — e.g., scientific research, technological innovation, public health impact, or economic development.

  • You are well-positioned to advance your proposed endeavor, evidenced by publications, leadership roles, funding, traction, or business success.

  • It is beneficial for the U.S. to waive the job offer and labor certification because your work is significant enough to warrant self-petition.

  • Typical applicants: scientists, researchers, IT professionals, AI/ML specialists, entrepreneurs, founders, healthcare professionals, engineers, policy analysts, educators, and cultural professionals.

Roadmap & Timeline

Step 1 — Profile Evaluation & Evidence Collection: Gather documents proving your advanced degree or exceptional ability, plus evidence supporting the NIW Dhanasar criteria (substantial merit, well-positioned, national benefit).

Step 2 — Preparing the Petition: Your attorney prepares and files Form I-140 with a detailed petition letter and supporting exhibits.

Step 3 — Adjustment of Status or Consular Processing: After I-140 approval (or concurrently, if eligible), you apply for I-485 if inside the U.S., or attend a consular interview if outside the U.S.

Step 4 — Green Card Issuance: Upon approval, you receive permanent resident status.

Securing Residency for Your Family

Allows immediate relocation for your spouse (eligible for work authorization) and unmarried children under 21 to live and study in the United States.
